Judgment
Heard Mr T.V.Kalyan Singh, learned counsel for the petitioner and Mr. M. Sharath Shantha Reddy, learned counsel for the respondent. Perused the record.
The Transfer CMP is filed under Section 24 of CPC seeking transfer of O.P No.8 of 2026 pending on the file of Family Court, Adilabad District to the file of Family Court, Nizamabad.
The petitioner-wife who is a Medical Practitioner sought transfer on the ground that she is a resident of Nizamabad, dependant on her parents and unable to travel to Adilabad on each date of hearing.
The Transfer is opposed by the respondent-husband who is also a Medical Practitioner residing at Adilabad. The respondent filed counter suggesting neutral venue at Nirmal, which is at a distance of 67.7 Km. from Nizamabad and 79.8 Km. from Adilabad, instead of Nizamabad which is at a distance of 151 Km. from Adilabad.
During arguments, consensus is reached between the counsels that in case, a neutral venue is to be decided for prosecution of O.P, Hyderabad would be suitable according to the petitioner. The learned counsel for respondent also agreed for transfer of O.P to the Family Court at Hyderabad. Both the learned counsels also requested that the presence of their respective party may be dispensed with whenever not necessary and permission be accorded for attending proceedings through video conferencing and for recording of evidence through an Advocate Commissioner.
In view of the foregoing, the Tr.CMP is disposed of directing transfer of O.P.No.8 of 2026 pending on the file of the learned Family Court, Adilabad District to the file of Family Court at Hyderabad. Both parties are permitted to attend the court proceedings through video conferencing and both parties may avail the facility of recording evidence through an Advocate Commissioner. The court concerned shall transfer the entire case record duly indexed within one month from the date of receipt of copy of this order.
Pending miscellaneous applications, if any, shall stand closed. No costs.
