Criminal Petition No.12998 of 2026 is filed by the petitioners seeking to quash the proceedings in C.C.No.1309 of 2021 on the file of the III Additional Judicial Magistrate of First Class, at Hanumakonda, registered for the offences punishable under Sections 420 and 408 read with 34 of the Indian Penal Code, 1860 (for short 'IPC').
Heard Mr. Nikhil R Chainani, learned counsel for the petitioners in Crl.P.Nos.12885 and 12998 of 2026 and learned counsel for respondent No.2 in Crl.P.Nos.12912, 12932, 12985, 12986 and 12987 of 2026, Mr. B. Raveendra Babu, learned counsel for the petitioners in Crl.P.Nos.12912, 12932, 12985, 12986 and 12987 of 2026, and learned counsel for respondent No.2 in Crl.P.Nos.12885 and 12998 of 2026 and Mr. V. Jithender Rao, learned Additional Public Prosecutor for respondent No.1.
Learned counsel for the petitioners submits that at the instance of elders and well wishers, the parties have entered into a settlement and filed appropriate applications seeking to compound the offences and to record the compromise. Along with the said applications, both parties have also filed joint memos.
This Court vide orders, dated 11.08.2026 and 12.08.2026, directed the parties i.e., the petitioners, respondent No.2 and the victim, to appear before the High Court Legal Services Committee, Hyderabad, on or before 21.08.2026 for their identification. In compliance of the said orders, the Secretary, High Court Legal Services Committee, has submitted reports, dated 20.08.2026 and 21.08.2026, stating that all the parties were duly identified with the copies of their Aadhar Cards/passport. It is further stated that all the parties have willfully and without any coercion entered into compromise.
Learned Additional Public Prosecutor has not opposed the same.
In view of the said reports and also in view of the compromise entered between the petitioners and respondent No.2 as well as the submissions made by the respective parties, I.A.Nos.2 and 3 of 2026 in Crl.P.Nos.12885, 12912, 12932 and 12998 of 2026 and I.A.Nos.3 and 4 of 2026 in Crl.P.Nos.12985, 12986, and 12987 of 2026 are allowed. Consequently, the proceedings in C.C.No.13131 of 2019 on the file of the XVII Additional Chief Judicial Magistrate, at Nampally, Hyderabad, C.C.No.6353 of 2019 on the file of the XIII Additional Chief Judicial Magistrate, at Nampally, Hyderabad, C.C.No.194 of 2021 on the file of the X Additional Judicial Magistrate of First Class, Ranga Reddy District, at Kukatpally, SC.POCSO.No.285 of 2024 on the file of the Fast Track Sessions Court for Expeditious Trial of Rape and POCSO Act Cases, HACA Bhavan, POCSO Court Complex, Hyderabad, SC.No.286 of 2024 on the file of the Fast Track Sessions Court for Expeditious Trial of Rape and POCSO Act Cases, HACA Bhavan, POCSO Court Complex, Hyderabad, SC.POCSO.No.287 of 2024 on the file of the Fast Track Sessions Court for Expeditious Trial of Rape and POCSO Act Cases, HACA Bhavan, POCSO Court Complex, Hyderabad, C.C.No.1309 of 2021 on the file of the III Additional Judicial Magistrate of First Class, at Hanumakonda, are hereby quashed against the petitioners.
Accordingly, these Criminal Petitions are allowed, subject to payment of Rs.2,50,000/- (Rupees Two Lakh Fifty thousand only) to the High Court Legal Services Committee, Hyderabad and Rs.50,000/- (Rupees Fifty thousand only) to the Telangana High Court Advocates Association, Hyderabad, by the petitioners, on or before 05.09.2026.
The Registry is directed to issue copy of the order soon after the payment as stated supra.
Miscellaneous applications, pending if any, shall stand closed.
