Shri M.P. Dixit, learned counsel for applicant is present. Shri T.N. Thakur, ld. Sr. CGSC, on receipt of advance copy of O.A. has appeared for the opposite parties.

MA No. 541/2026

An MA bearing no. 541/2026 has been filed by the applicants (37 in number) praying for liberty to jointly pursue such original application No.655/2026. On being satisfied that the applicants share a common grievance and are pursuing a common cause of action, such liberty is granted under Rule 4(5)(a) of CAT (Procedure) Rules, 1987. MA no. 541/2026 is accordingly disposed of.

Heard learned counsel for the applicant.

Learned counsel for applicant has submitted that the father of applicant was a government servant who died in harness on 06.05.2020 while serving as Public Relation Inspector (East). Thereafter an application for compassionate appointment of applicant no.2 was moved but due to the reason that he obtained only 47 marks in merit list his case could not be recommended for appointment on compassionate ground. He further submitted that as per the Rule, applicant has more chance to be considered for his appointment for which the applicant has sent his representation on line on 18.07.2025 but the same could not be considered. Learned counsel for applicant has further submitted that he may be given an opportunity to submit a fresh representation in the light of earlier representation of the applicant and applicant is hopeful that if his representation is considered and decided by the authority concerned in accordance with the law/rules, her grievance shall be redressed. He further submitted that the purpose of filing of this OA will be fulfilled if the opposite parties/competent authority is directed to consider his representation of the applicant in accordance with rule/law and decided the same by way of passing a reasoned and speaking order within specific time.

Learned counsel for the opposite parties raised no objection to the submission of counsel for applicant.

Considering the submission of counsel for applicant, the O.A. is disposed of without entering into merit of the case, at admission state itself with direction to applicant to file a fresh representation alongwith the certified copy of this order within a period of three weeks from today by annexing a copy of his previous representation dated 18.07.2025 to the Competent Authority. On receipt of the representation, the Opposite parties/competent authority shall consider and decide the same strictly in accordance with Rule/law and by passing a reasoned and speaking order within a period of 90 days.

Accordingly, the O.A. is disposed of with the above directions. No costs.
