Judgment
This Appeal under Sections 16 and 18 of the National Green Tribunal Act, 2010 is directed against the order dated 19.12.2023 issued by Regional Office, Uttar Pradesh Pollution Control Board (UPPCB), Kanpur restricting the operation of all the industries at Jajmau, Kanpur Nagar discharging polluted/coloured water, during Magh Mela-2024.
Learned Counsel appearing for the Appellant fairly submits that there is nothing wrong in the order under the appeal but on the basis of that order, units which are doing even dry process work and do not discharge any pollutant or coloured effluents are being stopped. She submits that though the industries in question are not covered by impugned order yet the concerned authorities are taking steps to close the units on the basis of the impugned order.
Since the impugned order does not suffer from any illegality, therefore, in this Appeal, no interference in the impugned order is required. However, if the order under challenge is misinterpreted by any authority or Appellants have any grievance in respect of wrongful implementation of the impugned order, then they will be at liberty to approach the appropriate authority in accordance with law.
Appeal is accordingly disposed of.
