Judgment
The second Counsel on record, Ms. Anjali Gupta, appears on behalf of the applicant/FC and states that the order of this Tribunal dated 20.12.2024 was conveyed to the IRP in the first week of January, 2025. However, as per the portal, the order dated 20.12.2024 was uploaded on the website on 30.12.2024, as there was a vacations.
Further, as per this order, the IRP was required to file its report under Section 99 of the IBC, 2016, within a period of ten days. However, no report was filed in the month of January when the matter was taken up on 31.01.2025.
Even today, after lapse of the entire month of February, again no report of IRP under Section 99 of 2016 is available on the file or filed separately through IA as ordered on 20.12.2024. There is a clear lapse on the part of the IRP in the matter.
Therefore, the Registry is directed to send the copy of this order to the IBBI for information and necessary action for the lapse on the part of the IRP.
Re-list on 28.03.2025.
