Judgment
P.V.Kunhikrishnan, J.
This writ petition is filed with following prayers:
i. Call for the records leading to Ext.P9 G.O. and quash the same by issuing a writ of certiorari or other appropriate writ, order or direction since the same has been issued in utter violation of the provisions contained under Article 338B and 342A of the Constitution of India.
ii. Issue a writ of a mandamus or other appropriate writ, order or direction to set aside Ext.P10 report/advice prepared by the 3rd respondent since the same is vitiated by irrelevant considerations and prepared without any proper study and collection of quantifiable data.
iii. Declare that the respondents have no authority to issue a G.O. in the nature of Ext.P9 in view of the 102nd Constitutional Amendment Act 2018.
iv. Declare that the Nadar belonging to Christian Religious Denominations other than the SIUC is not a caste included in the OBC list existing and operative in the state and under List III of Schedule to Part 1, KS&SSR.
v. Issue such other and further orders as are deemed just and necessary in the facts and circumstances of the case.
Today, when this writ petition came up for consideration, the learned Advocate General submitted that the Government is taking steps to withdraw Ext.P9 Government Order, with liberty to issue a fresh order in accordance with law.
In the light of the above submission, I am of the view that the main prayer in this writ petition is infructuous.
Therefore, this writ petition is dismissed as infructuous, leaving open all the contentions of the petitioners and the respondents. The State is free to issue a fresh order in accordance with law.
