Judgment
Sathi Kumar Sukumara Kurup, J
This Criminal Original Petition is filed to withdraw case in MC.No.21 of 2023 from the file of Family Court, Theni and transfer the same to the file of any other competent Court.
2.When the case came up for hearing today, the learned Counsel for the Petitioner submitted that the Petitioner is a practising Lawyer. He had filed a petition for divorce before the Family Court, Theni. Since he is a practising lawyer, the learned counsel for the Respondent and the Bar members of Bodinayakkanur are against him. Therefore, he is unable to attend the Family Court, Theni.
3.Considering the same, the learned Principal District Judge, Theni, is directed to offer his/her remarks regarding the threat held out by the members of the Bar Association, Bodinayakkanur, against the individual Bar member, who is facing litigations before the Court at Theni. The learned Judge, Family Court, Theni, shall also offer his/her remarks regarding the appearance of the Petitioner/husband in O.P.No.622 of 2022 and the appearance of the first Respondent in the maintenance case in MC.No.21 of 2023.
4.The remarks shall reach this Court through e-mail on or before 09.01.2024.
Registry is directed to list this case on 10.01.2024.
