Judgment

This Criminal Original Petition has been filed to withdraw the maintenance case in M.C. No.250 of 2025, on the file of Principal Judge, Family Court, Chennai and transfer the same to any other competent Court.
The learned counsel for the petitioners would submit that the first petitioner is the wife and the second petitioner is the son of the respondent herein. The respondent/husband has filed a petition for divorce and first petitioner/wife has filed a petition for restitution of conjugal rights. Further, the first petitioner has a filed a maintenance case in M.C. No.250 of 2025, on the file of the Principal Judge, Family Court, Chennai, seeking maintenance for herself and her minor son/second petitioner and all the cases are pending. The first petitioner filed a memo before the Family Court, seeking joint trial, whereas the learned Family Court Judge, without considering the same, is bent upon to proceed with the maintenance case. Thereby, the present petition is filed.
Notice to the respondent returnable by two weeks. The learned counsel for the petitioners is permitted to serve private notice on the respondent as well as to the counsel appearing for the respondent before the Family Court.
Post the matter after two weeks.
Till then, there shall be an order of interim stay of all further proceedings in M.C. No.250 of 2025, on the file of Principal Judge, Family Court, Chennai.
