Keeping in view Lhe totality of the facts and circumstances of the present case coupled with the fact that the impugned order has been passed by the

Govt. of India, Ministry of Defence at Delhi, objection raised by the respondents' side with regard to territorial jurisdiction of the Principal Bench to

entertain the instant OA carries no weight.

We have considered M.A. No. 1159 of 2019, vide which the applicant is seeking condonation of delay of 72 days in filing the OA. Although the

respondents have raised objection in allowing the application, yet in the interest of justice, the same is allowed and delay stands condoned.

M.A. No. 1159 of 2019 stands disposed of accordingly.

O.A. No. 585 of 2019:

Heard. Admit.

Post-admit Notice is waived by Mr. Tarunvir Singh Khehar, learned counsel for the respondents. Service is thus complete.

Learned counsel for the respondents states that counter affidavit filed at the pre-admission stage may be treated as post-admission counter affidavit.

Statement made at the Bar stands recorded. In view of this, M.A. No. 1820 of 2019 filed by the respondents for condonation of delay in filing the

counter affidavit has rendered infructuous.

Rejoinder is also filed in advance which shall now form part of the records.

List again on 23rd October, 2019 for final hearing, on which date the respondents shall keep the entire record of the applicant ready for perusal of the

Tribunal.
