Judgment
Present OA has been filed by the applicant seeking directions to the respondents to calculate 50% of dues as per government order dated 22.10.2018 and payment of arrears along with interest.
Heard. Admit.
Issue notice to the respondents in MA as well as in OA. Notice is accepted by Gp Capt K.S.Bhati, Sr.CGSC on behalf of the respondents.
At the outset, learned Sr. counsel for the respondents objects to the territorial jurisdiction of this Tribunal on the ground that the applicant is resident of UP. In this regard, counsel for the applicant has referred to the impugned order (annexure A1) for submitting that the same was passed from New Delhi. Therefore, part of cause of action has arisen at Delhi. In this regard, it is submitted by counsel for the applicant that Annexure A1 cannot be termed to be an impugned order.
Mr. Pandey submits that the same order was challenged by filing OA No. 780 of 2020- Gp. Capt. Bhasker Kumar Das versus Union of India and others which has been admitted. It will be open to the respondents to take all necessary objections in the counter affidavit.
List on 25.10.2021 before the Principal Registrar for completion of pleadings.
