Judgment
Time was granted on the last occasion to the Petitioner for filing a Rejoinder qua reply filed by Respondent No.2. Further time is prayed on behalf of the Petitioner for filing a Rejoinder. As prayed for, four weeks time is allowed to the Petitioner for filing their Rejoinder qua reply of Respondent No.2.
Mr. Pratyaksh Sharma appearing for Respondent No.1 in B.P.No.687 of 2020 prays for further time for filing a reply on the ground that his client resides in Bengaluru, thus, they could not get the reply duly supported by an Affidavit. The Hon'ble Bench by the Order dated 13/04/2021 was pleased enough to direct that in case the reply is not filed within four weeks from then, the right to file the reply shall stand closed.
Further, it was prayed on behalf of Respondent No.1 that they intend to file an appropriate Miscellaneous Application for acceptance of their reply in the matter to which the Petitioner objected. It was further directed by the Order of the even date that in case the Respondent No.1 in B.P.Nos.684 and 689 of 2020 do not appear by the next date fixed in the matter, the matter shall be heard ex-parte against them. Accordingly, B.P.Nos.684 and 689 of 2020 shall be heard ex-parte qua Respondent No.1.
List the matter on 6th October, 2021 for directions. The Respondent No.1 in B.P.No.687 of 2020 may file its Miscellaneous Application in between, if so advised.
