Heard both the sides.
This bail application has been filed on behalf of Sitesh Kumar Modak @ Sitesh Modak who is in custody since 13.06.2025 in connection with S.T. No. 526 of 2025 arising out of Jharia P.S. Case No. 154 of 2025 for the offence registered under Sections 118(1), 126(2) and 109 of the BNS, 2023 pending in the Court of learned Addl. Sessions Judge-IV, Dhanbad, is pressed into motion.
As per the prosecution case, petitioner is the husband of the informant and is alleged to have subjected her to cruelty as a result she was living in her natal home. On 12.06.2025, petitioner came to her house, abused and assaulted her. It is alleged that he stabbed her with knife.
It is submitted by the learned counsel on behalf of petitioner that the allegation of stabbing with knife is not substantiated by injury report which only talks about lacerated wound.
Learned A.P.P. for the State opposed the prayer for bail.
It is submitted by the learned counsel for the informant that there was a pattern in which victim used to be assaulted on earlier occasions also. On the date of incident, the assault resulted not only in fracture of left hand, but also the discharge report from the hospital which has been filed along with the counter- affidavit shows that she had received stab wound over her peritoneal area.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
