Judgment
Vide order dated 14.09.2017, notice was issued on the opposite party No.2. The Office Note suggests that the notice sent by ordinary process has been served personally upon the opposite party No.2.
Inspite of service of notice, no body appears on behalf of the opposite party No.2. So, the matter is taken up and heard on merit.
Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is an accused for allegedly committing the offence punishable under Sections 420, 354 of the Indian Penal Code.
The allegation against the petitioner is that he has taken Rs.5000/- from the opposite party No.2 on the pretext of providing employment for her. It is also alleged that he molested the opposite party No.2. It is submitted that the petitioner is in custody since 17.04.2017 till he was released on provisional bail by an order dated 14.09.2017 passed by a Coordinate Bench of this Court.
In view of the aforesaid facts, since the petitioner has already remained in custody since 17.04.2017 and was released on provisional bail, I confirm the provisional bail granted to the petitioner vide order dated 14.09.2017. Petitioner is directed to appear before the Trial Court within a period of two weeks from today and furnish fresh bail bonds. Additionally petitioner will also deposit a sum of Rs.10,000/- with the Trial Court and the Trial Court shall disburse the said amount to the opposite party No.2 after proper identification.
With the aforesaid directions, this application is allowed.
