This Writ Petition under Article 226 of the Constitution is filed seeking to declare the action of the respondents in not releasing admitted due amounts to the petitioner’s institution towards reimbursement of the expenditure incurred by the petitioner under the “Reimbursement of Tuition Fee (RTF) scheme” for the academic years 2018-19 to 2020-21 for obvious reasons as illegal and arbitrary.

The learned counsel for the petitioner has submitted that when an identical issue arose before this Hon’ble Court in W.P.No. 21342 of 2022, after elaborate hearing, considering the contentions of the both the parties, this court has disposed of the writ petition on 29.09.2022 with the following directions:

“Even otherwise, the Welfare Schemes extended by the Government cannot be defeated on minor technical laches on the part of the authorities. If it is so, welfare schemes introduced by the Government will be frustrated. The intention of the scheme is to encourage the students belonging to weaker sections. As such, even minor laches on the part of the colleges can be ignored. Even prior to the joining of degree, in their intermediate also those students fee was reimbursed by the Government. Furthermore, the respondents reimbursed the entire fees of those very same students for their II year and III years. In such an event, this court is inclined to direct the respondents to release the admitted amount i.e., 16,67,120/- to the petitioner institution.

In that view of the matter, the writ petition is disposed of directing the respondents to reimburse the admitted fee of i.e., Rs. 16,67,120/- to the petitioner, within a period of three (3) months from the date of receipt of a copy of this order.”

In view of the above directions of this Hon’ble Court, this writ petition is also disposed of on the same identical lines as was granted in aforementioned W.P.No. 21342 of 2022 dated 29.09.2022. No costs.

Registry is directed to attach a copy of the order passed in W.P.No. 21342 of 2022 dated 29.09.2022 to this order.

As a sequel miscellaneous application, pending, if any, shall also stand closed.
