Judgment
Mr. A. Das, learned counsel has filed the reply on 17.10.2020. Having perused the reply this court is of the view that Mr. Das, learned counsel on bonafide belief had submitted the vokalatnama sent by some persons personating as the respondents No.13, 14 and 15. Mr. Das, learned counsel has sincerely apologized for his lapse. He is a young and promising lawyer and as such he is cautioned to accept the vokalatnama in future after due verification. In ordinary course, the vokalatnama shall be executed by the persons who wants the counsel to represent, in his presence. In exceptional cases, however, the vokalatnama can be executed without appearance before the counsel, if the same is executed before a person of confidence.
List the matter on 23.11.2020 when the parties shall appear in person.
Mr. P.K. Dhar, learned counsel has appeared for the applicant whereas Mr. P. Maishan, learned counsel has entered in the appearance for the respondents No.3b, 3c and 3d. Mr. A. Das, learned counsel has appeared for a series of respondents.
Thus, Mr. Das, learned counsel who was engaged by the respondents No.13-36, 39-44 and 46-50 has formally apprised this court that he will retire as the counsel for those respondents and he will take appropriate steps by 21.10.2020.
Be that as it may, Registry shall supply a copy of this order to Mr. D.C. Roy and Mr. R. Nandi, learned counsel for the respondents No.1a, 1b and 1c and 2 and Mr. P. Maishan, learned counsel appearing for the respondents No.3b, 3c and 3d. That apart a copy of this order be directly sent to the remaining respondents those who are not represented by Mr. D.C. Roy, learned counsel, Mr. R. Nandi, learned counsel and Mr. P. Maishan, learned counsel.
It is reiterated that all the respondents, even those are represented by the counsel and the petitioner shall appear in person before this court on the next date without fail. It is also reminded that if they failed to appear before this court on the next date, a bail able warrant would be issued for ensuring the attendance in the court.
