ORDER
Counsel, Abdullah Bharmal appeared for the Financial Creditor. None present for the Corporate Debtor.
Heard the Counsel appearing for the Financial Creditor/Petitioner. The above Company Petition is filed by the Siemens Financial Services Pvt. Ltd. for initiation of Insolvency Resolution Process against the Respondent, Amit Suresh Lodha who is the personal guarantor of the Corporate Debtor.
The Financial Creditor invited the attention to the master lease agreement dated 17.05.2014 executed by the Respondent. Learned Counsel appearing for the Financial Creditor invited the attention of this bench to the demand notice dated 01.06.2021 thereby calling upon the Personal Guarantor to pay an outstanding amount of Rs. 9,06,24,375/-(Rupees Nine Crores Six Lakhs Twenty-Four -Thousand Three Hundred and Seventy-Five only) and also invited the attention of this bench to the proof of the demand notice. The Financial Creditor also suggested the name of the Resolution Professional along with his consent letter which is annexed to the Petition.
After hearing the submissions and upon perusing the above documents, this bench appoints Mr. Rajeev Mannadiar having IBBI Registration No. IBBI/IPA/-001/IP-P00212/2017-18/10412 as Resolution Professional to examine the Petition and filed his report within 10 days from the date of the uploading the order. List this matter on 09.11.2023 for submission of the report.
