Judgment
ORDER
Heard the Counsel appearing for the Financial Creditor/Petitioner. The above Company Petition is filed by the Indian Bank for initiation of the Insolvency Resolution Process against the Respondent, Mr. Sabas J Rodrigues who is the personal guarantor of the Corporate Debtor.
The Financial Creditor invited attention to the copy of the deed of guarantee executed by the Respondent in favour of the Petitioner dated 14.02.2019 and 25.11.2020. Learned Counsel appearing for the Financial Creditor further invited the attention of this bench to the demand notice (Form-B) dated 07.11.2023 thereby calling upon the Personal Guarantor to pay an outstanding amount of Rs. 34,64,23,853.20/- and also invited the attention of this bench to the proof of service of the demand notice. The Financial Creditor has not suggested the name of the Resolution Professional along with the Petition.
After hearing the submissions and upon perusing the above documents, this bench appoints Mr. Santanu T Ray having IBBI Registration No. IBBI/IPA-002/IP-N00360/2017-2018/11055, registered address; 144, 14th Floor, Mittal Court, B Wing, Nariman Point, Mumbai, Maharashtra, 400021 and email id; santanutray@aaainsolvency.com and mob. no. 9167086977, as Resolution Professional to examine the Petition and file his report within 10 days from the date of the uploading the order. List this matter on 28.11.2024 for submission of the report.
