The petitioner is aggreived by Annexure-E order passed in CMP No.240/2022 in Crime No.122/2022 of Chadayamangalam Police Station, on the file of the Judicial First Class Magistrate Court, Kadakkal. As per the aforesaid order, the application submitted by the petitioner under Section 451 of Cr.P.C. praying for release of his autorickshaw bearing registration No.KL-25/D-4963 was dismissed.
The aforesaid autorickshaw was siezed by the police as part of the investigation in Crime No.122/2022 of Chadayamangalam Police Station. The petitioner who claimed to be an owner of the aforesaid autorickshaw submitted an application for release of the vehicle, which stands dismissed as per Annexure-E order.
The reason for dismissal is that the petitioner, who is not a registered owner, failed to produce any authentic document establishing his ownership over the said vehicle.
When the Crl.M.C. came up for consideration, the learned counsel appearing for the petitioner submits that he has in his possession, the original sale agreement of the vehicle in his favour and he can produce the same before the learned Magistrate.
In such circumstances, in order to enable the petitioner to establish his ownership over the vehicle, by producing necessary documents, Annexure-E order is set aside. The learned Magistrate shall reconsider the application submitted by the petitioner on the basis of the documents to be produced by the petitioner and take appropriate decision, as expeditiously as possible.
