Heard the parties.
This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 528 of the B.N.S.S., 2023 with the prayer to quash and set aside the order dated 04.07.2025 passed by learned Additional Sessions Judge-I-cum-Special Judge, Bokaro in Misc. Cr. Application No.285 of 2025 arising out of Harla P.S. Case No.78 of 2024 corresponding to G.R. Case No.916 of 2024 whereby and where under consequent upon the failure of the petitioner to produce the documents of his ownership of the vehicle seized, of which the petitioner claims to be the registered owner; the claim of the petitioner to be the registered owner of the vehicle in question could not be verified by the police and upon such report being submitted to the court concerned by the police, the court concerned has rejected the prayer for release of the vehicle.
Learned senior counsel for the petitioner drawing attention of this Court to Page-56- Annexure-5, which is the photocopy of the Certificate of Registration of the vehicle in question, submits that the same goes to show that the petitioner is the owner of the vehicle in question and the petitioner is ready and willing to produce the copy of the same both in the Court concerned and before the police.
In view of the submission, this Cr.M.P. is disposed of with liberty to file a fresh application annexing therewith the documents of ownership for release of the vehicle in question along with documents of ownership of the vehicle concerned in the Court concerned as well as furnishing the copy of the same to the concerned police station and it is further ordered that if such an application is made, the same will be considered by the court concerned in accordance with law.
This Cr.M.P. is disposed of accordingly.
