Judgment
This application seeks execution of order of this Tribunal dated 04.01.2022 in O.A No. 374/2021 for compliance of norms relating to installing requisite Chimneys on Diesel Generators, resulting in violation of provisions of the Air (Prevention and Control of Pollution) Act, 1981. The Tribunal directed the State PCB to take remedial action. Operative part of the order is reproduced below:-

In view of above, we direct the State PCB to take further remedial action in terms of stack height, control of emissions and noise and operation as per GRAP and conclude the same as far as possible within one month from today.”
According to the applicant, no action has been taken on the ground and the violations are continuing.
In view of above, let the State PCB look into the matter and take remedial action as already directed. We also direct that a copy of the order dated 04.01.2022 in O.A No. 374/2021 be forwarded to the District Judge, Ghaziabad for being entrusted to the jurisdictional Civil Court for execution under Section 25 of the NGT Act, 2010.
The Application is disposed of.
