Hon’ble Mr. R. N. Singh, Member (J):

The present Contempt Petition has been filed alleging willful defiance of the directions of this Tribunal in order/judgment dated 31.01.2020 in the aforesaid OA. The operative portion of the order/judgment reads as under:-

“8.

Admittedly the applicant is at Sl. No. 1 in the wait list. In view of the facts and circumstances narrated above, the OA requires to be allowed. Accordingly, the OA is allowed and the respondents are directed to consider the applicant for appointment against the vacancy arising due to non acceptance of said Ms. Deepthi M. or against the future vacancies.

There shall be no order as to costs.”

The learned counsel for the respondents submits that in compliance of the directions of this Tribunal, the claim of the applicant for appointment was considered and an offer of appointment has already been issued to the applicant.

Learned counsel for the applicant admits that offer of appointment has been received by the Petitioner. However, he submits that the applicant is yet to undergo medical examination and other formalities before the actual joining.

However, in the facts and circumstances, we are of the considered view that the directions of this Tribunal have substantially been complied with. Accordingly, the CP is closed and notices are discharged. However, the petitioner is at liberty to agitate his grievance, if any, still survives, in accordance with law. No costs.
