Judgment
S. S. Mishra, J
Mr. D.P. Dhal, learned Senior Counsel appearing for the petitioners submits that since the present case is arising out of a complaint case, he would be impleading the informant as opposite party no.2.
Mr. Ragada, learned Additional Government Advocate is appearing for the opposite party no.1-State and waives the notice.
Issue notice to the newly added opposite party no.2 by Registered Post with A.D. making it returnable within one week. Requisites shall be filed within a week.
The petitioners are aggrieved by the order dated 26.12.2023 passed by the learned G.N-cum-J.M.F.C., Sukinda in 1CC No.04 of 2022 rejecting the application of the petitioners under Section-205 Cr.P.C.
Mr. Dhal, learned Senior Counsel further pointed out that by rejecting the application of the petitioners under Section-205 Cr.P.C., stringent process has been issued against them by the impugned order dated 26.12.2023.
The order dated 26.12.2023 passed by the learned G.N-cum-J.M.F.C., Sukinda in 1CC No.04 of 2022 issuing N.B.W. against the petitioners is kept in abeyance till the next date of hearing.
