Judgment

The present criminal miscellaneous petition under Section 482 of CrPC has been preferred by the petitioner for quashing the FIR No. 414/2023 lodged at Police Station Nohar, District Hanumangarh and for quashing of the entire proceedings in pursuant to the FIR aforesaid.
Learned counsel appearing for the petitioner while relying upon the application dated 20.01.2024 sent by the respondent No. 2 herein to the Investigating Officer Police Station Nohar, District Hanumangarh submits that a compromise has been arrived at between the petitioner and the complainant-respondent No. 2. Therefore, it is prayed that the present criminal miscellaneous petition may be allowed and the impugned FIR and entire proceedings in pursuance thereof may be quashed qua the petitioner.
Learned Public Prosecutor opposed the prayed made by the learned counsel for the petitioner.
Learned counsel appearing for the complainant is not in a position to dispute the fact that a compromise has been arrived at between the petitioner and the respondent No. 2 herein.
Heard learned Counsel for the parties and perused the material available on record.
having regard to the facts and circumstances fof the case and after perusal of the application dated 20.01.2024 sent by the respondent No. 2 to the Investigating Officer, Police Station Nohar, District Hanumangarh and in view of the fact that a compromise has been arrived at between the parties, this Court deems it appropriate to allow the present criminal miscellaneous petition.
Accordingly, the present criminal miscellaneous petition is allowed and the impugned FIR 414/2023 lodged at Police Station Nohar, District Hanumangarh and the proceedings initiated pursuant thereto, are quashed and set aside qua the petitioner.
The stay petition also stands disposed of accordingly.
