This bail application has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.
The petitioner is seeking regular bail in connection with Bariatu P.S. Case No.195 of 2018 corresponding to S.T. No.46 of 2021 for the offence under Sections 302/34 of the Indian Penal Code pending in the Court of Sri Anil Kumar Mishra, learned Additional Judicial Commissioner-I, Ranchi.
The F.I.R. reveals that the son of the informant was murdered. The petitioner seems to have been implicated on the confession of Kalu Lama and Rohit Munda.
It has been stated that the co-accused Rohit Munda has already been granted bail by this Court in B.A. No. 9049 of 2019 and Kalu Lama in B.A. No. 9346 of 2019. The name of the petitioner therefore surfaced only on account of confessional statement of co-accused persons who have been granted bail by this court.
Mr. V.S. Sahay, learned A.P.P. for the State opposed the prayer for bail. Regard being had to the attending facts and circumstances, I am inclined to enlarge the above named petitioner on bail, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Anil Kumar Mishra, learned Additional Judicial Commissioner-I, Ranchi in connection with Bariatu P.S. Case No.195 of 2018 corresponding to S.T. No.46 of 2021.
