JUDGMENT AND ORDER (ORAL)

This matter has come up on the prayer of the appellant, seeking suspension of sentence and for grant of bail on medical grounds, inasmuch as, it has been submitted by Ms. P. Chettri, learned Legal Aid Counsel that the appellant had recently undergone medical treatment at Civil Hospital, Shillong on 25.08.2026, for Laparoscopic Appendicectomy on 27.08.2026 under General Anesthesia (GA), after which, he was discharged on 04.09.2026.

It is also submitted that post discharge, the convict/patient was given the full medical treatment with post-operative advice. He was also prescribed medication and was asked to review his case with the doctor, who is presently posted at the prison.

It is also the submission of the learned Legal Aid Counsel that the family members of the appellant have expressed apprehension as far as his medical condition is concerned, stating that he requires careful attendance, preferably at home, for which prayer for suspension of sentence and for grant of bail was made.

This Court, on consideration of such prayer, has called for the medical status report from the District Prisons and Correctional Home, Shillong, and accordingly, vide medical status report dated 17.09.2026 issued by the Senior Medical & Health Officer, District Prisons & Correctional Home, Shillong, what is apparent is that the appellant/patient is presently surgically fit and fully recovered, however, he was advised to continue local wound care and to continue rest of the medications, which in this Court’s opinion, would be provided by the prison authorities available at the prison itself. The said status report was furnished by Mr. N.D. Chullai, learned AAG assisted by Ms. R. Colney, learned Addl. PP appearing for the State respondent, the same is brought on record and marked as Annexure-X.

In view of the said medical status report, at this juncture, we are not inclined to allow the prayer made.

Accordingly, this Misc. Case is hereby dismissed as devoid of merits. It is however made clear that in case of any complications which may arise as far as the case of the appellant is concerned, the prison authorities, particularly the attending doctor is to ensure that he is given the best of care.
