Heard Mr. K.Ch. Gautam, learned counsel for the petitioner who has submitted that the limited prayer of the applicant herein is for grant of interim bail so as to enable him to be referred for specialized treatment in a private institution of his choice, given the fact that he is suffering from Lumbar Spasm & Radiculopathy which is serious in nature and as such, liberty of this Court is sought for to allow the applicant to go on interim bail for such treatment.

It is also the submission of the learned counsel that the applicant has been given or rather referred for treatment by the Jail Authorities and has been admitted at Nongpoh Civil Hospital and was also discharged. But, however, on being discharged he was again referred to the same hospital on 05.09.2023, that is, yesterday.

Mr. N. Syngkon, learned GA appearing for the State respondents has, however, made a prayer for the latest medical status of the applicant to be produced before this Court before passing necessary orders.

This Court on consideration of the submission made, would deem it fit and proper for a medical report to be produced so as to know the latest status of the applicant and also as to the opinion of the doctor, if any specialized treatment is required or not.

In the meantime, it is incumbent upon the Jail Authorities to ensure that best possible treatment is given to the applicant/accused. He may even be referred to Government hospitals at Shillong or even NEIGRIHMS for that matter.

The prosecution is directed to furnish the said report on the next date fixed.
