M.A./4392/2026 – Application for exemption.

In view of averments made in the M.A. – application for exemption is allowed being just an exception.

Accordingly, M.A./4392/2026 stands disposed of.

M.A./4391/2026 - Application for joining together.

Present O.A. has been filed by 2 applicants seeking common reliefs against common cause of action.

In view of averments made in the M.A., present M.A. for joining together is allowed and applicants are permitted to contest the case in this O.A.

Accordingly, M.A./4391/2026 stands disposed of.

Present O.A. has been filed seeking direction to the competent authority amongst the respondents to consider and decide the pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly) by passing a reasoned and speaking order.

Learned counsel appearing for the applicants, after arguing for some time, submits that applicants would be satisfied if a direction is issued to competent authority amongst the respondents to consider the pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly) and decide the same by passing a reasoned and speaking order.

Issue notice to the respondents. Mr. Shadab Hussain Khan, proxy counsel for Mr. H A Khan, learned counsel appears on advance service and accepts notice on behalf of the respondents and service of notice to the respondents is waived of. He fairly submits that pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly) shall be considered in accordance with law, if not already decided.

Heard with consent. We have considered the matter. The applicants are seeking direction to the respondents to decide the pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly), we deem it just and proper that principles of natural justice would be met and hereby direct competent authority amongst the respondents to consider and decide the applicants’ pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly) by passing a reasoned and speaking order within a period of six weeks from the date of receipt of a certified copy of the order passed today and communicate the same to the applicants at earliest possible date.

Needless to say, we have not expressed any opinion on the merits of the case and respondents are free to decide the pending representations dated 02.06.2025 (Annexure A-1 colly) and 06.01.2026 (Annexure A-2 colly) by passing a reasoned and speaking order in accordance with law.

In view whereof, present O.A. stands disposed of in above indicated terms.

7.

There shall be no order as to costs.
