Both these O.As. are filed by the same applicants. The relief claimed therein inn inter connected. Hence they are disposed of by this common order.

The applicants are working as Assistants, in the establishment of Debt Recovery Tribunal (DRT). The cadre controlling authority is the Debt Recovery Appellate Tribunal. The next promotion is to the post of Section Officer. The applicants contend that though the draft seniority list for the post of Assistant was published on 29.11.2019 and the objections were invited, the final seniority list has not been published by the respondents as yet, and on account of that, the promotions are getting delayed. In this background, they filed O.A. No.2057/2020 with a prayer to direct the respondents to publish the seniority list for the post of Assistant. O.A. No.2056/2020 is filed with a prayer to direct the respondents to convene the Departmental Promotion Committee (DPC) for the purposes of promotion to the post of Section Officer.

We heard Mr. S K Gupta, learned counsel for applicants and Mr. R K Sharma, learned counsel for respondents, at the stage of admission, through video conferencing.

The main issue is about publication of final seniority list. The effort of the applicants is only to get the publication of final seniority and thereafter, convening the DPC for promotion to the post of Section Officer. The draft seniority list was published in the year 2019. Naturally, the administration needs time to consider the various objections in relation to the draft seniority list, and to issue final seniority list. It cannot be said that there was undue delay on the part of the respondents in this behalf. At the same time, an early action would avoid the stagnation among the concerned employees. The convening of DPC for promotion to the post of Section Officer would depend upon the publication of final seniority list, for the feeder post.

In the circumstances, the O.As. are disposed of by directing that:

(a)

The cadre controlling authority shall endeavor to publish the final seniority list for the post of Assistant within a period of three months from the date of receipt of a copy of this order; and that,

(b)

The steps for convening DPC for promotion to the post of Section Officer shall be taken within two months from the date of publication of the final seniority list.

There shall be no order as to costs.
