Judgment
Justice Rajiv Sharma, Judge,
The petitioner has approached this Court for the following reliefs:-
a) firstly, the respondent may be directed to release house rent to the petitioner with effect from 1.8.1995 to 11.12.2002 with interest at the rate of 18% per annum till the realization of the entire amount.
b) secondly, since he has acquired higher qualifications, he has not been given two advance increments with effect from 8.7.2003.
The stand of the respondent in the reply for not releasing the house rent to the petitioner is that since he was residing with his father, he was not entitled to the house rent allowance. That is the settled law, and such, the petitioner is not entitled to the relief of house rent, as prayed for by him.
Now, as far as the relief of granting two advance increments to the petitioner after acquiring higher educational qualifications is concerned, it shall be open to the petitioner to make a representation to the Commissioner, Municipal Corporation, within a period of four weeks from today. It shall also be open to the petitioner to point out the names of such persons to whom such benefit has been extended after they have acquired higher qualifications. The Commissioner, Municipal Corporation shall decide the same in accordance with law, that too, after taking into consideration all the pleas raised by the petitioner in the representation, within a further period of ten weeks. He shall pass a speaking/reasoned order. Accordingly, in view of the observations and discussion made hereinabove, the petition stands disposed of, so also the pending application(s), if any. No costs.
