The petitioner, Shri P.M. Hynniewta has filed the present petition under Article 226 of the Constitution of India seeking directions to the

respondents to unseal and unlock the stall allotted to the petitioner situated at Polo Municipal market, Shillong and also to restore its possession to

the petitioner.

Mr. S. Thapa, learned counsel for the petitioner submits that the petitioner does not want to pursue with the present petition and seeks

permission to withdraw the present petition with the liberty to avail appropriate legal remedy.

Learned counsel for the petitioner also submits that the petitioner has filed an affidavit dated 29.03.2017 seeking permission to withdraw the

present petition with liberty to approach the court as per law. Mr. K.P. Bhattacharjee, learned counsel for respondent No. 1 and Mr. K. Barua,

learned counsel for respondents No. 2 and 3 have no objection to the prayer made by learned counsel for the petitioner.

Considering the facts and circumstances of the case and submissions made by learned counsel for both the parties as well as affidavit dated

29.03.2017 filed by the petitioner, the present petition is dismissed as withdrawn with liberty as prayed.

Writ petition stands disposed of.
