Ms. P. Agarwal, learned Legal Aid Counsel has submitted that the appellant on being aggrieved by the judgment dated 26.09.2023 and order of sentence dated 27.09.2023 passed by the learned Special Judge (POCSO), West Garo Hills District, Tura in Special (POCSO) Case No. 13 of 2018 has preferred an appeal before this Court however in doing so, a delay of 1035 days has occurred. The applicant being illiterate and unaware of his legal rights, the same has attributed to the delay in approaching this Court within the time frame. After exhausting all means the applicant has sought for legal aid which is done so now. It is, therefore, prayed that the delay of 1035 days may be condoned in this regard.

Mr. S.A. Sheikh, learned Asst. P.P has no objection to the prayer made.

Accordingly, on consideration of the submission made and on perusal of the pleadings made in this application, this Court is persuaded to allow the prayer made. The delay of 1035 days is hereby condoned.

Registry to diarize the appeal and list the same for admission after 1(one) week.
