ORDER (ORAL)
Ms. P. Agarwal, learned Legal Aid Counsel has submitted that this instant application has been filed with a prayer for condonation of delay of 458 days in filing the related appeal after being convicted vide judgment dated 24.04.2025 and order of sentence dated 29.04.2025 passed by the learned Special Judge, West Khasi Hills, Nongstoin in Special (POCSO) Case No. 04 of 2022. The applicant being illiterate and unaware of his legal rights did not approach this Court within the time frame though the same was neither intentional nor deliberate. After exhausting all means the applicant has sought for legal aid, however in doing so the period for filing the related appeal has already lapsed. It is, therefore, prayed that the delay of 458 days may be condoned in this regard.
Mr. H. Kharmih, learned Addl. P.P has no objection to the prayer made.
Accordingly, on consideration of the submission made and on perusal of the pleadings made in this application, this Court is persuaded to allow the prayer made. The delay of 458 days is hereby condoned.
Misc. Case disposed of.
Registry to diarize the appeal and list the same for admission after 1(one) week.
