Judgment
O R D E R
Per. Hon’ble Mr. R.N. Singh, Member (J)
In the present Original Applicant filed under Sec. 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:-
(i)To allow the OA.
(ii)To grant the applicant, Pay Scale of Rs6,500-10,500/-Wef. 01/01/1996 and Rs 7500-12,000/- wef 31/12/2001, respectively, for the period of work as In-come Tax Inspector and/or Income Tax Officer.
(iii)To refix the pay and allowances of the applicant as per Vth CPC wef 01/01/1996 in the Pay Scale ofRs6500-200-10500, as ITI and Rs7500-12000/- as ITO as per his dates of promotion
(iv)Central Administrative Tribunal To direct the respondents to draw and pay con-sequential arrears of pay and refixation of pension and other pay & allowances and pensionary benefits.
(v)In the alternative to grant Pay Scale of Rs6,500-10,500/- for ITI and Rs 7500-12,000/- for ITO Wef. 01/01/1996 notionally, and arrears of Pay and Pension & Allowances wef. 21/04/2004i.e. the date of issue of OM At Annex A-3
(vi)To direct the respondents to pay interest @ 18% p.a. on the arrears.
(vii)Grant any other relief and issue such other suitable directions as this Hon'ble tribunal deems fit and proper in the facts and circumstances of the case.
Claim(s) of the applicant have been disputed by the respondents.
Today, the learned counsel, under instructions for the applicant submits that respondents have required the applicant to submit certain documents to deal with the claim(s). However, keeping in view the health conditions of the applicant, the applicant is not in a position to get out of his house and accordingly documents required by the respondents could not submitted to them by the applicant.

In the light of the aforesaid and without going into the merits, the present OA is disposed of with the following directions:
Applicant or his legal guardian/ legally authorized agent shall submit documents required by the respondent for considering the applicant’s claim(s) and complete other formalities as required under the rules and instructions to enable the respondents to consider the claim(s) of the applicant within 12 weeks from the receipt of copy of certified copy of this order.
If on receipt of the documents for and on behalf of the applicant and completion of other formalities, the respondents shall consider the claim of the applicant and pass necessary orders in this regard, as expeditiously as possible and preferably within 8 weeks thereafter.
OA is disposed of, in the aforesaid terms. No costs.
