The applicant is working in the Employees' Provident Fund Organization (EPFO) as Account Officer (AO). He was posted with respondent No.3 as Enforcement Officer (EO) from August, 2013 to 29.06.2016. Later, he was transferred to the Regional Office, Delhi (North) Respondent No.2 vide Office Order dated 29.06.2016. He contends that after his posting to the office of respondent No.2, a minor penalty charge-sheet dated 13.07.2016 was issued by the respondent No.3 who is not the disciplinary authority of the applicant and as such there is a clear violation of the relevant rules.
Aggrieved by this, the applicant has filed the present OA. He has also preferred an appeal dated 05.02.2020 and reminder dated 21.02.2020.
At the outset, learned counsel for the applicant submits that the applicant would be satisfied, if the aforesaid pending appeal followed by the reminder is decided within the stipulated time limit.
In view of the aforesaid submission, the OA is disposed of with a direction to the respondents to consider and decide the appeal of the applicant dated 05.02.2020 and reminder dated 21.02.2020 and pass reasoned and speaking order on the same, within a period of two months from the date of receipt of copy of this order.
Pending MA also stand disposed of. There shall be no order as to costs.
