Heard Mr. Sumeet Gadodia, learned counsel appearing for the petitioners and Mr. Kailash Prasad Deo, learned counsel appearing on behalf of the C.B.I.

With respect to a similar prayer earlier two cases were instituted being W.P.(Cr.) No. 393 of 2017 and W.P.(Cr.) No. 396 of 2017. Vide order dated 31.10.2017 a direction was given by this Court to the C.B.I. to produce the entire police papers before the learned Special Judge, CBI, Ranchi on 02.11.2017 and if the documents which is voluminous in nature could not be completed to be inspected by the said petitioner on 02.11.2017, it may spill over to the next date i.e. 03.11.2017.

At the outset, Mr. Sumeet Gadodia, learned counsel appearing for the petitioners, has submitted that the records were inspected on 02.11.2017 and in fact what the C.B.I. had asserted was found to be correct. The only grievance of the petitioners as of now is of the records being taken by the C.B.I. and not deposited in the court which the learned counsel for the petitioners apprehends would create a problem while hearing the discharge application preferred by them.

Mr. Kailash Prasad Deo, learned counsel appearing on behalf of the C.B.I, does not have any objection if the records are kept in the court under safe custody.

In view of the fact that the prayer of the petitioners made in these writ applications has already been redressed, no order is being passed on the same. However, with respect to the subsequent prayer made by the petitioners, it is directed that the C.B.I. shall deposit the records in the court and the learned trial court is directed to keep the records in safe custody.

These writ applications stand disposed of with the aforementioned observations.

Let this order be communicated through FAX to the concerned court and a copy of this order be handed over to the learned counsel appearing for the C.B.I.
