Judgment
O R D E R
By Hon’ble Mr. Justice Rajiv Joshi, Member (Judicial) :
Shri Balwant Singh, learned counsel for the applicant and Shri Anil Kumar, learned counsel for the respondents are present.
The instant Original Application has been filed by the applicant under Section 19 of Administrative Tribunal, Act, 1985 for the following relief(s) :-
“(i)Issue an order or direction in the nature of mandamus commanding and directing to the respondents authorities to consider the claim of the applicant, open the sealed cover considered by the Departmental Promotion Committee vide meeting dated 22.04.2024 and induct the name of the applicant in Group A/Junior Scale in the cadre of Indian Railway Service of Engineers and assign to the allotment of year 2021 after revising notification dated 15.05.2024 in accordance with seniority position of the applicant in All India integrated seniority list dated 24.11.2023.
(2)Issue an order or direction which this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the case in the favour of the applicant.
(3)Award to the cost to the applicant.”
Learned counsel for the applicant states that for redressal of his grievance, the applicant has preferred a representation dated 21.01.2025 (Annexure-A-3) through proper channel to the Deputy Direction Establishment (J.P.), Railway Board, New Delhi with copy to General Manager, North Eastern Railway, Gorakhpur (page 44 of the OA), which is still pending.
Learned counsel for the applicant further submitted that his grievance shall be redressed if a direction is given to the respondents to consider and decide the pending representation dated 21.01.2025 (Annexure–A-3) of the applicant by passing a reasoned and speaking order within a time bound manner.
Learned counsel for the respondents has opposed the prayer of the applicant.
However, in view of the limited prayer made by learned counsel for the applicants, no fruitful purpose will be served in keeping this O.A. pending. Accordingly, the OA is disposed of at the admission stage itself with direction to competent authority amongst the respondents to consider and decide the pending representation dated 21.01.2025 (Annexure–A-3) of the applicant by passing a reasoned and speaking order within a period of three months from the date of receipt of a certified copy of this order. The order so passed shall be communicated to the applicant without any delay. No order as to costs.
It is made clear that this Tribunal has not expressed any opinion on the merits of the case.
All MAs pending in this O.A. also stand disposed off.
