Judgment
O R D E R
PER HON’BLE JUSTICE ANIL KUMAR OJHA, MEMBER (J)
Heard learned counsel for the applicants, learned counsel for the respondents and perused the records.
Through this Original Application, applicants have prayed for the following relief (s):
“I. To grant Non Functional Grade Pay Rs. 5400/- (PB-2) from the date of completion of 4 years services in the Grade Pay Rs. 4800/- with all consequential benefits.
2.To revise the pay after fixing their pay in Grade Pay Rs. 5400/-and release arrears thereof while extending the benefits of the judgments rendered in the matter of M. Subramaniam and other such related matters alongwith interest @ 12% from the date of due till the actual date of payment.
3.Any other relief, which this Hon’ble Tribunal may deem fit, just and proper under the circumstances of the case, may also be passed.
4.Cost of the present case.”
At the outset, learned counsel for the applicants submitted that the instant O.A. may be disposed of as applicants are only seeking decision on the representations preferred by them in the light of judgments passed by Principal Bench of this Tribunal in O.A. No. 1982 of 2010:- Rajneesh Gupta and Ors. vs. Union of India & Ors. (Annexure No. A-5), Allahabad Bench of this Tribunal in O.A. No. 1318 of 2018:-Kaushal Kishore Bhashkar & Ors. vs. Union of India & Ors., (Annexure No. 9), this Bench in O.A. No. 545 of 2018:- Vikas Kapoor & Ors. vs. Union of India & Ors. (Annexure No. A-10), O.A. No. 622 of 2019 :- Bachan Deo Mishra & Ors. vs. Union of India & Ors, (Annexure No. A-11), O.A. No. 209 of 2020:-Rajesh Kumar Agnihotri & 2 others vs. Union of India & Ors. (Annexure No. A-12), Bangalore Bench of this Tribunal in O.A. No. 368 of 2022:- V. Bhaskar vs. Union of India & Ors. (Annexure No. A-13) and Allahabad Bench of this Tribunal in O.A. No. 471 of 2024:- Brijesh Kumar Pandey & Ors. vs. Union of India & Ors. (Annexure No. A-14) and ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representations of the applicants attached as Annexure No. A-7 [page 112-121 of the paper-book] to this O.A. in the light of aforecited judgments of the Allahabad Bench, this Bench and Bangalore Bench of this Tribunal by way of reasoned and speaking order within a stipulated period of time.
To this, learned counsel for the respondents orally opposed, however, submitted that in case the applicant’s representation is directed to be decided in the manner suggested, then at least three months’ time may be allowed for the same.
In view of the above submission, respondents/ competent authority are directed to consider and decide the representations of the applicants attached as Annexure No. A-7 [page 112-121 of the paper-book] to this OA in the light of judgments passed by Principal Bench of this Tribunal in O.A. No. 1982 of 2010:-Rajneesh Gupta and Ors. vs. Union of India & Ors. (Annexure No. A-5), Allahabad Bench of this Tribunal in O.A. No. 1318 of 2018:- Kaushal Kishore Bhashkar & Ors. vs. Union of India & Ors., (Annexure No. 9), this Bench in O.A. No. 545 of 2018:-Vikas Kapoor & Ors. vs. Union of India & Ors. (Annexure No. A-10), O.A. No. 622 of 2019 :- Bachan Deo Mishra & Ors. vs. Union of India & Ors, (Annexure No. A-11), O.A. No. 209 of 2020:- Rajesh Kumar Agnihotri & 2 others vs. Union of India & Ors. (Annexure No. A-12), Bangalore Bench of this Tribunal in O.A. No. 368 of 2022:- V. Bhaskar vs. Union of India & Ors. (Annexure No. A-13) and Allahabad Bench of this Tribunal in O.A. No. 471 of 2024:- Brijesh Kumar Pandey & Ors. vs. Union of India & Ors. (Annexure No. A-14) and pass a reasoned and speaking order as per law within a period of three months from the date of receipt of certified copy of this order, under intimation forthwith to the applicants.
It is made clear that nothing has been commented upon the merits of the case.
For avoidance of doubts, it is clarified that similarity of facts and applicability of aforecited judgments shall be determined by the competent authority itself while deciding the representations of the applicants.
The OA is disposed of accordingly. There is no order as to costs.
