Petitioner is aggrieved by the non-bailable warrant issued against him in S.C.No.1235/2022 by the Additional District and Sessions Court (for the trial of cases relating to Atrocities & Sexual Violence against Women and Children), Ernakulam.
According to the learned counsel for the petitioner, the petitioner was absent only on a day, i.e. 19.11.2024, for the reason that he was laid up due to dengue fever on that day. An application was preferred seeking to condone his absence for the day. The same was, however, rejected, is the submission made. Learned counsel would submit that the petitioner is prepared to surrender before the trial court and he seeks a direction to enlarge him on bail, upon such surrender.
In case, the submission made by the petitioner that he was absent only on a day is correct, petitioner's application for recalling the warrant will be considered by the learned Sessions Judge equitably and sympathetically. The petitioner shall also undertake to co-operate with the trial. Needless to say that, such bail application will be considered on the same day by the learned Sessions Judge.
With the above observations, this Crl.M.C. will stand disposed of.
