Judgment

Petitioner is the accused in S.C.No.359/2019 on the files of the Sessions Court-III, Pathanamthitta, arising out of Crime No.1039/201 of Pathanamthitta Police Station.
Since petitioner had absconded, the Trial Court has issued a non-bailable warrant against him. Petitioner has expressed his willingness to appear before the Trial Court and seek recall of warrant and apply for grant of bail. However, he apprehends that, his application will not be considered on the same day.
Having heard the learned counsel for the petitioner as well as the learned Public Prosecutor, I am satisfied that this criminal miscellaneous case can be disposed of with a direction.
Accordingly, if the petitioner appears before the Sessions Court-III, Pathanamthitta, within 10 days from today and seek an application for recall of warrant and for bail, the learned Sessions Judge shall consider the application, preferably on the same day itself. To enable the petitioner to appear before the Court as directed above, the non-bailable warrant issued against the petitioner shall be kept in abeyance till 22.03.2024.
Crl.M.C. is disposed of as above.
