Judgment
We find that the pagination is not properly done and therefore we are unable to look into the file. Registry is directed to ensure that correct
pagination is done. Further, we find that the impugned order dated April 13, 2021 is an order by which the appellant’s application for waiver of the
fine has been rejected. We do not find that the appellant has challenged the order by which the fine has been imposed. Until and unless the order
challenging the imposition of fine is challenged no relief can be granted to the appellant. Consequently, if the appellant chooses to challenge the order
by which a fine has been imposed the same may be done by moving an amendment application. List on July 14, 2021.
Parties are directed to take instructions from the Registrar 48 hrs. before the date fixed in order to find out as to whether the matter would be taken
up for hearing through video conference or through physical hearing.
The present matter was heard through video conference due to Covid-19 pandemic. At this stage it is not possible to sign a copy of this order nor a
certified copy of this order could be issued by the Registry. In these circumstances, this order will be digitally signed by the Private Secretary on
behalf of the bench and all concerned parties are directed to act on the digitally signed copy of this order. Parties will act on production of a digitally
signed copy sent by fax and/or email.
