The record reveals that the matter was first listed before this Court on 31.03.2010, on which date, the notice was issued and pursuant thereto, the matter was listed after fourteen years and during this intervening period, no efforts were ever made by the petitioner to get the petition listed. However, when the petition was listed before this Court on 16.07.2025, none had appeared on behalf of the petitioner. The record further reveals that on 02.09.2025, when the petition was listed, learned counsel appearing for the petitioner was directed to seek instructions with respect to subject matter of the case and report the same to this Court on the next date of hearing i.e. on today, but there is no representation on behalf of the petitioner today as well nor instructions have been reported to this Court. Thus, an inference can be drawn that the petitioner is not interested in prosecuting the present petition, as such, the present petition is dismissed for non prosecution. Interim direction, if any, shall stand vacated.
