The instant writ application has been preferred by the petitioners for the following reliefs:

“1(i) For equitable relief in the matter of payment of arrears of difference of salary for the period from 1989 to 2003 as has been allowed to the writ Petitioners of W.P.(S) No. 969/2006 and other analogous cases while considering that the matter has been agitated by the State authorities up to the Hon'ble Apex Court and they had lost, whereupon direction has been passed for allowing such benefits to all similarly situated Assistant Teachers.

AND

(ii)

For a direction(s) upon the respondent authorities to revise the pay scale of the Petitioners w.e.f. 1.4.1989 in the pay scale of Rs. 1400-2600 under 4th Pay Revision and to consequently replace the same in the pay scale of Rs. 5000-8000 under 5th Pay Revision and in the pay scale of Rs. 9300-34800 under 6th Pay Revision and to consequently release the same with arrears of difference of pay scale.

AND/OR

The Petitioners pray for passing of any other order/orders as your Lordships may deem fit and proper in the interest of justice.”

A counter affidavit has been filed in this case wherein at para 3 it has been stated that the grievance of the petitioners has been redressed.

Learned counsel for the petitioners submits that from para 3 of the counter affidavit it is clear that the claim of the petitioners has been entertained and the petitioners have been allowed revised basis pay of Rs. 1900/- per month after completion of 12 years of service as per resolution dated 18.12.1989 and also as per recommendation of 5th Pay Commission the basic pay w.e.f 01.01.1996 has been fixed at the rate of Rs. 6950/- per month. However, learned counsel submits that still monetary benefit has not been credited in the account of the petitioners as such some time may be framed so that actual fruits may be received by the petitioners.

Learned counsel for the resonant-State relies upon the counter affidavit.

Having regard to the aforesaid, it is evident from para 3 of the counter affidavit that the grievance of the petitioners has been redressed on paper however the payment has not been credited in the account of the petitioners and accordingly, the concerned respondent should ensure that the monetary benefit be extended in the account of respective petitioner as early as possible preferably within a period of 6 weeks from the date of receipt of copy of this order.

With the aforesaid observation, the instant writ application stands disposed of.
