Heard both the sides.
This bail application has been filed on behalf of Shankar Kumar Das who is in custody since 18.09.2025 in connection with Chandrapura P.S. Case No. 91
of 2025 for the offence registered under Sections 25(1-B)(a), 26, 35 of Arms Act pending in the Court of Addl. Chief Judicial Magsitrate, Bermo at Tenughat is pressed into motion.
It is submitted by learned counsel for the petitioner that the offence under the Arms Act will not be made out, as no firearm has been seized from the conscious physical possession of the petitioner but a knife has been seized from the petitioner dimension of which has not been mentioned clearly in the FIR. Though the petitioner has criminal antecedent, but not under any offence under the Arms Act or robbery.
Learned A.P.P. for the State opposed the prayer for bail.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below on the condition that one of the bailors should be the family members of the petitioner.
