Learned senior counsel for the appellant is permitted to delete the name of appellant No. 2 Lalan Paswan from the cause title of this interlocutory application.

Heard learned senior counsel appearing for the appellant Kunal Kishor Singh @ Kunal Kumar Singh and learned counsel for the State, on the interlocutory application filed by this appellant for granting bail, during the pendency of this appeal.

Appellant Kunal Kishor Singh @ Kunal Kumar Singh, along with other co-accused persons, has been convicted for the offence under Sections 364-A and 120-B of the Indian Penal Code and has been sentenced to undergo rigorous imprisonment for life with a fine of Rs. 5000/- for the offence under Section 364-A of the Indian Penal Code.

It is submitted by the learned senior counsel for the appellant that the case of the present appellant is on the similar footing as of the co-accused Chhotu Pandey @ Himanshu Pandey, Prakash Singh and Chandan Singh @ Chandan Kumar Singh, who have already been granted bail by this Court.

In the facts of this case, since similarly situated co-accused have been granted bail, we are inclined to release the appellant Kunal Kishor Singh @ Kunal Kumar Singh on bail. Accordingly, he is directed to be released on bail, during the pendency of the appeal, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IV, Palamau at Daltonganj, in connection with S.T. No. 108A of 2015.

This interlocutory application stands allowed.
