Shamim Ahmad vs State of Uttarakhand

Applicant- Shamim Ahmad, who is in jail in connection with FIR No. 8 of 2011, relating to offences punishable u/s 363, 366 and 368 IPC, Police Station Jaspur, District Udham Singh Nagar, has sought his release on bail.

Heard learned Counsel for the parties.

Learned Counsel for the Applicant submitted that there is allegation in the first information report against accused Salman that he abducted and eloped Nargis (victim). It is pointed out that Applicant is maternal uncle of said accused.

In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that Applicant deserves bail.

Bail application is allowed. Let the Applicant Shamim Ahmad be released on bail on executing personal bond and furnishing two sureties each of like amount to the satisfaction of Additional Chief Judicial Magistrate, Kashipur.
