Sachin Kumar vs State of Uttarakhand

Applicant Sachin Kumar, who is in jail in connection with Crime No. 35/113 of 2011, relating to offence punishable u/s 363, 366A, 376 I.P.C., Police Station- Cantt., District Dehradun, has sought his release on bail.

Learned counsel for the applicant submitted that as per the medical report, the girl is aged between 17-18 years. The medical report further shows that no evidence of forceful intercourse was found. It is pleaded on behalf of the applicant that he was in love with the girl. It is further pointed out that no hue and cry was made by the girl for four days, when she lived with the applicant in District-Saharanpur.

In the above circumstances, without expressing any opinion as to final merits of the case, this court is of the view that applicant deserves bail.

The bail application is allowed. Let the applicant Sachin Kumar, be released on bail, on his executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Dehradun.
