Judgment
In the matter of removal of encroachment in C.W.J.C
No. 21626 of 2011, the writ petition was disposed of directing the Circle Officer, Motihari to visit the area, conduct measurement and make inquiry with regard to the encroachment, if any, and if the Circle Officer, Motihari comes to the conclusion that there is encroachment in the area, directed to move before the DCLR in accordance with statutory provisions. The show cause filed by the Circle Officer, Motihari, goes to show that he has visited the spot in question on 02.07.2014, conducted inquiry and found encroachment in the area and the report was submitted to the DCLR, Motihari and on the basis of same BLDRA Case No. 07 of 2014-15 was registered by the DCLR, Motihari. Supplementary show cause has been filed on
26.08.2014.
That being so, for the present no further action is required to be taken in the matter. In case the proceeding initiated in the case is still pending before the DCLR, Motihari, he is directed to take steps for disposal of the same at the earliest.
With the aforesaid observation, this application stands disposed of.
