The petitioner, who is working as a TGT (Medical) in Government Senior Secondary School, Hathol, District Hamirpur and is under transfer to Government Senior Secondary School, Gondpur Buhla, District Una has come up before this Court seeking cancellation of order of transfer Annexure P-1 on the grounds that her case is covered under clause 5.4 of the Comprehensive Guiding Principles-2013, of the transfer policy applicable in the State of Himachal Pradesh, which provides concession to couples as well as bad health of her child.
Notice. Ms. Rita Goswami, learned Additional Advocate General appears and waives service of notice on behalf of respondents No.1 and 2.
In view of the nature of the order, we propose to pass, no response is required from the respondents.
Consequently, this petition is disposed of with liberty to the petitioner to make representation to the first respondent, within one week, in accordance with the transfer policy. On receipt of such representation, the said respondent shall decide the same sympathetically keeping in view the bad health condition of her child and in the light of the transfer policy occupying the field, and pass appropriate orders, within two weeks. Subject to filing of representation within the time-frame mentioned above, status quo, as of today, qua the impugned order Annexure P-1, shall be maintained, till the decision of the representation. Pending application(s), if any, are closed.
