Judgment
Heard learned Counsel for the Complainant who has produced an Affidavit on behalf of the Complainant stating as follows:
The Complainant has filed the captioned Complaint against the Opponent builder for various deficiencies and short comings, and the same is pending disposal.
The Complainant humbly states that due to certain circumstance prays that she be permitted to withdraw the captioned Complaint with the liberty to file a fresh in the appropriate forum.
Learned Counsel for the Opposite Party submits that the Complaint was admitted long back in 08.08.2019. On 01.06.2022, the Complainant was given time to file the Rejoinder and Evidence by way of Affidavit which Order has not been complied with even though subsequent indulgences were granted by this Commission.
None appeared for either of the Parties on 22.05.2023, whereupon this matter has been listed for directions today.
Keeping in view the development aforesaid of the Affidavit tendered on behalf of the Complainant today, a copy of which has been handed over to the learned Counsel for the Opposite Party, and since the Complainant wishes to withdraw the Complaint in order to enable her to avail of any legal remedies that might be available in law, this Complaint is consigned to records.
