Shailesh Yadav @ Shailesh Kumar vs State of Bihar

Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Wazirganj P.S. Case No. 346 of 2023, registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504/34 of the Indian Penal Code.

According to FIR, co-accused Rahul Kumar, Mantu Kumar, Shailesh Yadav @ Shailesh Kumar (the petitioner) and Pintu Kumar, along with some unknown persons, fired and injured the husband of the informant. The reason behind the occurrence was that there had been an altercation between the petitioner and his father and the injured, who is the petitioner’s uncle, had intervened in the matter.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that in his statement, the injured (the victim) stated that the first shot was fired by co-accused Rahul Kumar and the petitioner also fired at him, but he was missed slightly.

The petitioner has three criminal antecedents. There is specific allegation against him of firing at the informant.

In my view, the petitioner does not deserve the privileges of bail, which is hereby rejected.
